By accessing the services, requesting quotations, or entrusting cargo to SAJEX FREIGHT LTD ("Company", "we", "us"), the client ("Customer", "Shipper") agrees to be bound by these Terms and Conditions. These terms govern all freight forwarding, customs brokerage, warehousing, and logistics operations conducted by SAJEX FREIGHT LTD.
Scope of Logistics Services
SAJEX FREIGHT LTD operates as a licensed freight forwarder and logistics coordinator. We arrange international carriage via ocean vessels, cargo aircraft, rail networks, and road trucking fleets. Individual transport contracts, bills of lading, and formal quotations supplement these general terms.
Quotations & Pricing Structure
Freight rates and service quotations are subject to specific commercial terms:
- Quotations remain valid for 30 calendar days from issue date unless explicitly stated otherwise.
- Rates are subject to fluctuation based on ocean bunker fuel surcharges (BAF), air fuel adjustments, currency exchange rates, and carrier peak season surcharges.
- Customs duties, import taxes, port demurrage, storage fees, and government inspection costs are payable separately by the shipper.
Shipper Obligations & Declarations
The client warrants and guarantees full compliance with the following responsibilities:
- Providing 100% accurate weight, volume, cargo description, and commercial value figures.
- Ensuring export-compliant packaging, palletization, and dangerous goods (Hazmat) labeling.
- Furnishing accurate commercial invoices, packing lists, and certificates of origin for customs clearance.
- Full compliance with Canadian export controls, US sanctions, and international trade laws.
Liability Limits & Conventions
As a freight forwarder, SAJEX FREIGHT LTD acts as an agent. Our liability for cargo loss, damage, or delay is governed by international conventions:
- Ocean Carriage: Hague-Visby Rules and COGSA limitations.
- Air Freight: Montreal Convention / Warsaw Convention limits.
- Standard Limitation: Maximum liability is strictly capped at 2 SDR per kilogram of gross weight damaged, unless higher value is declared in advance and additional insurance purchased.
Cargo Insurance
Standard freight carriage rates do not include cargo insurance unless explicitly confirmed in writing on the invoice. We strongly recommend that all shippers procure comprehensive All-Risk Cargo Insurance. SAJEX FREIGHT LTD can facilitate marine cargo insurance coverage upon written request.
Governing Law & Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of Canada and the Province of Alberta. Any legal dispute or claim arising from carriage services shall be submitted to the exclusive jurisdiction of the courts of Calgary, Alberta, Canada.
